Bailable warrant against the Complainant in a Criminal Case

14-Oct-2023 (In Criminal Law)
Our car got stolen in September 2020. We filed an online FIR. A few days back my mother got a call from a policeman for appearing at the Districts Court in Rohini on a said date. She could not appear because of health reasons and the notice time was too short. We now receive another call for a new date to appear and it seems a bailable warrant is to be issued against the complainant as per the previous summary. What would happen if my mother cannot appear now also? Do we have to pay any penalty?

We have to file a vakalatnama in the court with cancellation of bailable warrants issued against your mother with medical documents on the date fixed. If you do this process you won't have to pay any fine or penalty and will not face any consequences for not appearing on the last date of hearing. I practice in rohini court too. if you need my assistance you may consult me.

it is because you are not obeying the order of the court . everyone should obey and be present before the court when ever you receive any summon from court. in you sitution if mother not able to be present before the court she can be represented by advocate in the court.

You need not worry as it's just a bailable warrant. You or anyone else can always appear on behalf of your mother on the next date of hearing with the application for cancellation of warrants along with the medical papers of your mother. After that the warrants will be cancelled and the case will continue against the accused person.

Do engage a lawyer and appear along with him in the court. In case Bailable Warrants has been issued against your mother do comply and not fail to appear else NBW will be issued. You may connect with better particulars
