Bail procedure in case of arrest
07-Jul-2023 (In Criminal Law)
I have someone known who has been arrested by CBI.i don't know whether it's an arrest. He was working in a company and I have heard it was involved in chit fund. He has left the company in 2014 and the case has been filed in 2017. The case is filed in chattisgarh durg and the person is from felhi. What is the procedure for the bail if he has been arrested?I don't know what kind of offence it is. They have filed 420 and 120 sections on him. They took him to tiz hazari court and from there took him for durg.the person was only the employee of the company. What can we demand from the CBI or what shall we do ?They have asked us to wait for 8-10 days. And then we will tell you what to do next. I am not sure why they have said so.Can we apply for the bail? And a medical examination was done of my relative before taking him. Let me know what will be the cost of the bail and all.
as per the details what you are providing ,this is the primary procedure done by the CBI means they r investigating a case ,but none of the department can keep a person detained with them without presenting that person before the court .. and if they r presenting him before court then there would be for sure some details and FIR with them.. u can contact me .I have a team of senior lawyers with me who dealt with these kinds of cases .u can contact me thru app ...then we can discuss this in detail.
Hi
I hope you have taken a copy of the RC/FIR from CBI officials as it looks like it is a case registered in Chhatisgarh. They must have produced him in tis hazari since they have to produce an accused before a magistrate within 24 hours of his arrest. You need to share the details of the complaint and all the facts regarding it and then only we will be able to ascertain the strategy behind it. Please feel free to contact for further queries.

the procedure in case of arrest is that the person is produced in court. within 24 hours after which the judge is satisfied he is sent to 14 days police custody. after which an application for bail can be filed before the court in whose jurisdiction the person is. it is very important to have the copy of FIr and understand his role before the bail can be applied..bail will be filed on the date when the Person before Court

he can apply for regular bail as per the procedure in CrPC code. Bail is a right of accused which court generally consider and grants. bail and not jail is a rule.
