Attempt to rape and molestation

There was an incident in 2012. The brother in law of a girl tried to rape her. In process of that attempt he badly molested her. That was the time when she was about to marry her boy friend. In fear of social stigma she could not take any action. Then the moved to the US. She told the entire incident to her husband. Now she is back in Bangalore and pursue that case to put the man behind bars. Is it possible?

It is better not to proceed as it will be difficult to prove the same after 4 years further so much of delay in filing complaint weakens the case and probably less chances that he will be convicted so better not to proceed it is too late.

There is no limitation u/s CrPC 468 to report late. However, there has to be cogent reason for not reporting earlier.Within 24 hours of the incident. Medical check ups need to be performed within the stipulated time. It should not be a matter of years, but a matter of some minutes or hours

Why not. If there was molestation and if there is enough evidence to show that molestation was there, you still can file a police complaint giving all proper reasons for the delay in filing the complaint.

The event - attempt to rape- in all probability might have taken place when no one else was present, and there will not be any evidence. The person who attempted will naturally deny it now. She can only give a complaint to police. But it will fail for lack of evidence and later she may face defamation action from him.
