As you are telling what will happen if the charge sheet is sent after 90 days. If the charge sheet is not filed within 90 days, the accused has the fundamental right to default bail. There are many guidelines of the High Court. Contact me for more information.

on the above mentioned query the legal opinion is that if chargesheet has been filed after the prescribed period that is 90 days, then the FIR or complaint case has to be dismissed by the hon'ble high court in writ petition under 482.

आप साफ साफ कहे कि आपकी समस्या क्या है। चार्जशीट भेजने से मुलजिम को तभी फायदा हो सकता है जब IO मुलजिम का नाम चार्जशीट में निकाल दें। और 90 दिन में चार्जशीट तभी जमा होती है जब मुलजिम जेल में हो। अगर जेल में नही है तो अभी चार्जशीट जमा नही होगी।

default bail ka right hai lekin agar wo jail me hai to ye depend karta hai ki bail kab move ki jate hai 7/8 ke sath kon si dhara lagi hai uske bare me batye tabhi mai clear bata paunga bail ki sthiti isaliye aap phle proper details de uske bad aagli jankari sahi paye
