12-Mar-2023 (In Criminal Law)
A person has filed a complaint against me in the police station yesterday morning alleging that I have molested them, tried to break down their door now the complainant is ready to compromise the matter externally without police being involved, do I need to accompany them to the police station or give anything in written to the police?

Dealing with police stations is tricky. It is not advisable to give any money to the opposite party without making sure he doesn't acknowledge it. It's always better to execute an agreement or memorandum of understanding with the opposite party while entering a settlement so that he doesn't drag you to the police station in future. If the police were involved then yes get it written on Rs 100 stamp paper and signed by the parties. The stamp paper must mention that there was nothing in between the parties and the complaint is withdrawn after mutually agreeing to each other.

yes you should enter into compromise in writing...he should say in writing that there was no molestation and misconceptions of facts...this written document should be given to police so that they can close the complaint. it is advisable to engage a lawyer becouse once the complaint is in police then they can do anything to extract money from you.

If police have not registered FIR, in that case investigation officer himself will write settlement and get sign from both thr parties. If Police have registered FIR then everything will happen via court and you need to hire Advocate for the same. Thanks n b in touch

Dear client It depends on the fact if any FIR or an official complaint has been filed against you. In case of no such complaint / FIR, you are not required to accompany them, in the contrary situation, it is advisable that you visit the police station and ensure the police officer draws up a settlement agreement and takes the statement of the complaint and well as yours. Feel free to get in touch to discuss further,
