Q: Difference Between Ipc 354 And 354A
If someone touch my private part from behind in crowded bus .Then that person will be charged under ipc 354 or 354A .Will he get bail

Section 354 deals with assault or force on a woman with the intent to outrage her modesty, basically it's done touching the women while Section 354A deals with sexual harassment which is done by making unwelcome sexual advances, or requests for sexual favors, or any other conduct of a sexual nature, which creates an intimidating or offensive environment for the woman.
Q: Quashing CC in High court for false court direction FIR section 156(3)
I worked in my friends company as admin/project manager. There was huge salary and incentive pending for four years. When asked the pending arrears he terminated me and I asked my pending through email he came to my home and gave a part payment cheque and I deposit it for collection but it returned as insufficient fund. He gave false complaint to police that I stole 3 cheques, misused 2 lac from his company. So CSR was filed by police and upon enquiry it was proved that he has given only one cheque and all other allegation in the complaint was false. CSR was closed as compromise affected. Now he approached court for FIR direction under section 156(3) surpassing the entire early complaint to police. The inspector also has hidden the CSR filed & closed by him early and filed FIR against me under section 294(B), 406, 420, 381&506(1). The case is now numbered as CC in the court and summon was served to me. Kindly let me know whether there is any way to quash my charge sheet in high Court.
Advocate Ravi Panwar answered
you should first apply for anticipatory bail before session court and then to HIGH Court.Simultaneously you should file Quashing petition u/s 482 CrPC before concerned High court. You should procure all the communication with ex-employer and the settlement aggreement. You should also file civil recovery suit for outstanding salary and a cheque bounce case, this will strengthen your defence.
Q: Fake RAPE CASE................
My ex threatenes to me that she will file fake rape case against me.I have deleted that message. We never had sex. After few month I texted her "kya hua rape case file nhi ki"..Will that message put me in trouble.I have never done wrong. My ex hates me bcoz i told her parents about relationship.
Advocate Ravi Panwar answered
See our law are made that way , even if you have not done anything once the allegations are made against you , the burden of proving non-guilty is upon you and you will be unnecessarily harrased till you be proved non guilty.Ist of all should not have send her the aforesaid message she can use it to corroborate her allegation.Solution:- Try to make her say on chat that you guys were not physical during your relationship or even if physical then that was consensual without promise to marry. and she is just threatening you because you told her parents.Try to calm the situation amicably otherwise you will be in unnecessary trouble for 1-2 yrs
