Family consent is not legally required. The marriage under Special Marriage Act is fully valid and recognized across India. Protection if Family Threatens Since both are major (30+), they have constitutional right to marry by choice. If there is threat or pressure, they can seek police protection and also file a writ petition in High Court for safety

Yes, Special Court Marriage is the correct and safest option for a Hindu boy + Muslim girl, both 30+, even if families do not support. This marriage is done under the Special Marriage Act, 1954 (not Hindu or Muslim law). Eligibility (you already qualify) Groom: Hindu, age above 21 Bride: Muslim, age above 18 Both unmarried / divorced / widowed Sound mind Not within prohibited relationship Consent of family is NOT required Step-by-step process (Special Marriage Act) Step 1: Choose Marriage Officer Marriage is registered before the Sub-Divisional Magistrate (SDM) / Marriage Officer Either: Place where boy resides, or Place where girl resides At least one party must have resided there for 30 days Step 2: Notice of Intended Marriage Joint notice is filed under Section 5, Special Marriage Act Submitted to Marriage Officer with: ID proof (Aadhaar / Passport / Voter ID) Date of birth proof (10th marksheet / birth certificate) Address proof (minimum 30 days residence proof of one party) Passport-size photographs Marriage Officer displays notice on office notice board. Step 3: 30 Days Notice Period (Mandatory) Law requires 30 clear days During this period: Anyone can file objection only on legal grounds Family objection without legal ground has no value If objection is illegal or baseless, SDM rejects it. Step 4: Marriage Registration & Solemnization After 30 days: Both appear before Marriage Officer Three witnesses required (friends, colleagues, not relatives compulsory) Sign declaration under Section 11 Marriage is solemnized and registered Marriage Certificate issued same day or within few days Important safety & privacy points No religious conversion required Marriage is fully valid across India Police protection can be taken before or during notice period if threat exists Supreme Court has clearly protected interfaith couples Time & cost Time: Minimum 30–35 days Government fee: Very nominal (₹100–₹200 approx.) Advocate help is optional but useful if families are hostile If families are threatening or trying to stop You can: File protection application before High Court Or give representation to SSP / SP Or move habeas / protection writ if harassment starts Very important advice Do NOT do temple / nikah / conversion first. That creates unnecessary legal and police complications. If you want, I can: Draft Notice of Intended Marriage Prepare police protection application Guide you on which district is safest to register Explain how to handle objections legally Just tell me the state and district where you plan to register.

For a Hindu boy and Muslim girl, marriage can be lawfully solemnized under the Special Marriage Act, 1954, without conversion of religion. Since both of you are above 30 years of age, you are fully eligible under law.
