Need to initiate legal action against the bank for service deficiency
30-Apr-2023 (In Consumer Court Law)
I have/had a different relationship like saving bank account, credit cards, personal loan, merchant relationship with the bank.
The bank kept my payout on hold as a result of that I was not able to pay to the bank toward its credit cards dues.
The bank charged a huge amount of interest and penalty for the delay in payment.
The bank blocked my saving bank account as a result of that the EMI of other loans got dishonoured and I end up paying the interest and penalty to the other banks as well.
the bank harrassed through various recovery calls and by sending various recovery agents.
You can either file a recovery suit in civil court or a consumer case before the consumer commission (state or national depending upon the amount of recovery) or you can file both simultaneously. You should definitely take immediate action against the bank and get your hard earned money back.

You should first file a police complaint against them. Secondly you should file a complaint with consumer forum and thirdly you should file a complaint with ombudsman which will take a strict action against just mal practices.

If you've experienced service deficiency by a bank in India and want to take legal action, you can file a complaint against the bank in the Consumer Court. Here's how you can initiate legal proceedings:
- Gather Evidence: Collect all relevant documents, records, and evidence of the service deficiency you've experienced. This may include transaction records, correspondence with the bank, and any other proof of the issue.
- Attempt Resolution: Before filing a complaint, try to resolve the issue by contacting the bank's customer service or grievance redressal mechanism. Document all communication during this process.
- File a Complaint with the Bank: If the issue remains unresolved, file a written complaint with the bank. Request a complaint or reference number for future reference.
- Contact RBI: If the bank does not respond satisfactorily or in a timely manner, you can escalate the matter to the Reserve Bank of India (RBI). Visit the RBI website to file a complaint online.
- Consumer Court Complaint or Civil Suit for Recovery: If both the bank and RBI fail to resolve the issue, you can file a complaint in the Consumer Court or a recovery suit. You will need to prepare a detailed complaint outlining the service deficiency, the steps you've taken to resolve it, and the relief or compensation you are seeking.
- Legal Representation: It's advisable to consult with a consumer rights lawyer or advocate experienced in consumer court matters or recovery matters. They can guide you through the legal process and help build a strong case.
- Consumer Court Jurisdiction: Identify the appropriate jurisdiction of the Consumer Court where you should file your complaint. This depends on the location of the bank branch and your place of residence.
- Hearing and Resolution: The Consumer Court will schedule a hearing, where both parties will present their case. If the court finds in your favor, it can order compensation or relief for the service deficiency.
