Impact on Decree Holder by NCLT case by others
13-Jul-2023 (In Consumer Court Law)
Hi, my case is under execution from UP State consumer court against builder. However, other buyers submitted case in NCLT against same builder. What is side impact on my case, should I go with CoC claim.
See ideally both work in different domains but it is likely that the builder may opt for stay in any other proceeding which would mean you will have to go ahead with the CoC.
The same thing happened in the Jaypee case. In the present case it will have to be independently checked in your case.
Please feel free to discuss.
Yes, please submit a claim, if you haven't done so already. otherwise you stand to lose out on your claim. admission of your claim will be easier since you have a decree in your favour
meanwhile, if the nclt passes an order section 14 and you don't file a claim, as per the Supreme Court judgement you will not be eligible to execute your decree.
