Q: how to prove false allegations by wife in court ?

Hindu marriage: If the wife makes false allegations of mental harassment against the husband and in-laws, how to deal with the matter legally?

1. Please clarify if you want to continue with the marriage or not. If not then ideally you should approach the Court immediately for a Divorce Decree. 2. Alternatively there are various remedies available to you in case yo wife is making false allegations. You may approach to file a defamation case etc. Once discussed, better Legal Strategy can be adopted. Thank You.



Q: Builder is delaying the Collaboration project and Asking for money

Hi , We are building our house on collaboration basis. Builder is delaying the Project.He is saying that he will build our house once he will get the client. This is something not written in the contract . He is not using material as per the contract. Also saying that he will use material of his choice. He is demanding money on regular basis which is not as per the contract .He is saying if you want to go to court , go , You will not get anything from there. Please help us. He assured us he will build our house in 12 months however, its been 11 months not ever 10 percent of construction work is completed

In this case, we need to peruse the agreement and then we can decide the appropriate strategy. I would want to see what your collaboration agreement states. Q: How to prevent Stay Order on property which is legally divided ?

I have a property which is legally divided in sub registrar office in delhi with oral demarcation in property papers. But how to prevent other people to take stay for any reason when I will be doing physical partition.Does Caveat petition is of any help ?

Yes obviously, once we have filed the caveat nothing can be done without our knowledge and court will not pass any order without hearing us. If at all such stay is still granted, we will have then immediately seek for vacation or stay. But in the present taking recourse of a Caveat Petition is the most feasible option. Thank You.

Hi, my case is under execution from UP State consumer court against builder. However, other buyers submitted case in NCLT against same builder. What is side impact on my case, should I go with CoC claim.

See ideally both work in different domains but it is likely that the builder may opt for stay in any other proceeding which would mean you will have to go ahead with the CoC. The same thing happened in the Jaypee case. In the present case it will have to be independently checked in your case. Please feel free to discuss.
