How to respond to the version filed by opposite party

The opp party has filed a version with the following statement "the reliefs prayed for in comp. falls beyond the pecuniary juri. conferred by cons prot act bu this honble comm. and hence on this ground alone the complaint shud be dismissed." "No cause of action exists as agnst opp party" "there is no defi of service" "it is submitted that this is a comercial cont. and ajudcation req detailed evidence to be recorded which is beyond the purview of the act" the case was filed in Oct'15 in state forum as we were directed by the dist forum, the prop was still not reg then.

Sir,
From your version it seems that you have filed a complaint undr S.12 of the Consumer Protection Act against a builder. The term Consumer is having limited scope and some time it is also mistaken of facts. For example you can not file a complaint against your vendor for breach of terms and conditions of the agreement before the conumer forum because it is a conntract between the parties and the jurisdiction falls before the civil courts. Herein your case you have not cleralymentioned for what relief you approched the forum. Please furnish full details.

From the statement made by you it looks like you have filed a case which may be agreement which is in commercial in nature. In a consumer case any you must prove that u r a consumer and it shud not be for commercial purpose. Unless one sees the case paper it is difficult to comment on your question.
