How to get money back car with major fault sold by dealer

04-Jul-2023 (In Consumer Court Law)
We bought a used car for 2 Lks, during test drive the dealer said car is in perfect condition except a small sensor problem which shows up during driving( which indicates engine check) . He said this could be fixed for ₹1000. But later on when we checked with authorised service center, we came to know that it was major problem in the engine could cost upto 1.5 lks to fix. Now the dealer is saying that we did test drive and accepted so he is not responsible for the problem. It is just one month since we bought this and we paid full cash as we trusted that dealer. We just have a paper signed by him, a 3rd party and ourself as a proof. Please mention what kind of legal action can be taken against him?

You can send a lawyer notice against the dealer and ask the dealer to give another car for the amount you paid or else you can ask the dealer to repair the said fault. If your request is not rectified you can file a case in the consumer forum.

Negligence, deficiency and unfair trade practices by a party can be sued before consumer forum. Keep the papers intact and cause a notice to alert them that you intend to contemplate a legal action and procee d.

Hello,

You can file a case before the consumer court as the dealer has suppressed the information before selling you the car.

If you want more detailed advice on your matter, i will have to look a the documents that you have as proof.
