I had been lured by Star inn to purchase their holiday package. I didn't consent initially but eventually was coerced through repeated offers to pay 1.6 lakh as emi. They made me sign a contract document without giving time to read. The whole process was time pressure driven with an intent to defraud. However, immediately i realized my mistake & requested for refund, which was promptly refused citing contract. The company has jurisdiction in Nainital for arbitration. I have already written to credit card representative to stop payment by raising dispute transaction. I have also written to the company to refund the amount, in case of failure to do so i shall have to lodge an FIR & subsequently take legal recourse. They have asked for meeting which i have accepted at my office. Although, the payment has been stopped, however what is the future course of action in the case. Will it be possible to get money back in total. Contract says 25 k deduction on cancellation. Help please

This is a clear cut case of cheating, fraud and misrepresentation. A perusal of the agreement is needed for determination of the recourse. Arbitration may be an option however the amount does not appear to be conducive for the same. Further and better particulars are needed for an effective opinion.

I have perused your query and would advise you to issue a legal notice to the concerned directors of the company seeking refund on account of coercion and unfair trade practice. Further would advise you to file a complaint before the concerned police station regarding the same. In the event they dont comply with the terms of the notice, you may file a consumer complaint. you can file a complaint against them before the district consumer forum. Jurisdiction will be where the office of the opposite party is situated. besides this you can file a criminal complaint to Police and if Police doesn't register an FIR you can approach court
