You are entitled to claim it through consumer forum. but before that it is advisable that a legal notice is sent to them, so that the pre requisite for approaching the consumer forum is complied with and they might settle your case at legal notice stage only.

If they are not listening to you then you can send them a legal notice and in that notice you can write either refund my money back along with compensation or face legal action.
