Case pending in NCLT Chennai and the same case is filed in civil Cour.

The company has sold some land property and regarding the land sale one of the share holder (30% holdings) has filed a case in NCLT Chennai and its pending in NCLT. Meanwhile the share holder has also approached civil courts to set a side the sale. Now the question is can a civic court has the jurisdiction or the NCLT has the jurisdiction to run the case

the civil case could be transferred to nclt if both issues are one and the same by filing transfer case at madras high court. the civil court is having jurisdiction if there is a violation of contract of sale. if it is shares then it should not be tried at civil court

after the comments of the companies act 2013 the the power to provide remedy regarding all company affairs is vested with NCLT. The NCLT has exclusive jurisdiction to adjudicate for all company matters. the civil court jurisdiction is barred completely. section 430 of the companies act 2013 expressly bars the jurisdiction of the civil court regarding any matter related to the companies affairs.
