Builder delayed possession now asking extra charges for FSI

28-Mar-2023 (In Consumer Court Law)
I had booked a flat in 2010 and registered agreement for the same in 2011.The possesion date was mentioned as Dec 2015.However the builder delayed and finally offering possession March 2018.The agreement has listed development charges as 31000.However now he is claiming over 10 lakhs in the same category calling it as charges for Fungible FSI due to changes in DCR regulations in 2012.He refuses to give possesion unless the additional charges are paid.No prior intimation received of these charges prior this. What is my next step?

Dear Client,
As per RERA builder has binding to give possession in stipulated time as per mention in agreement. If builder refuse to give possession in time so you go through the civil suit against the builder in the court of law.

You will have to give the notice to the builder for deficiency in service for not giving the possession of the flat within stipulated time period. You will also need to deny the claim of the builder.
