Whether tenant can be evicted on the ground of non payment of rent

Tenant not paying rent for several years.Land lord filed eviction. Tenant has claim that he has paid by cash (did not mention about withness /no receipt is there).Tenant want to diposit rent to court from current month and need protection against eviction. Court can consider "paid by cash" , where no document / witness present as a valid rent payment ? Is this a valid ground for eviction ?

Paying rent is a responsibility of a tenant if the tenant fails to pay rent then its an automatically ground for eviction.if the tenant says that he has paid rent by cash and does not able to provide sufficient document in support of his claim then it automatically does not prove he has paid rent previously.If the Court allows the tenant to pay rent through Court from the current month or earlier which depends upon the discretion of the Judge then it will automatically save the tenant from eviction.

If he doesn't have the rent receipts then it will be considered as non payment of rent. You can give a notice of 30days to evict for non clearance of rent.
If he don't clear the full due rent by one month after giving the notice, you can evict them.

Court may consider to provide temporary protection against eviction if the Tenant deposit rend from current month, but Suit must be continue. If he further default, then it would presume that the allegation is absolutely true against him. And then the Court do not hazitate to evict him.
