Vehicle reparing delay-cliam requested

Dear sir, My self Neeraj Jain residing 102 Man Bhawan Nagar Indore is registered owner of TATA LPT-3118 truck registered in Indore RTO as MP-09HG8526, insured with TATA AIG got accident and take over at TATA authorised dealer work shop for repairing. (Details attached below) My two complains are as below- 1. The insurance company TATA AIG gives only 50 % of repairing cost. 2. The TATA authorised dealer take much more time on repairing then committed resulting the financial loss and burden upon me which is liable to be claim over dealer. Since it is a commercial vehicle and during this repairing time the instalment and manpower and Gov. tax and permit is continuous going on. So that this amount with interest is claimed to the dealer. (M/s. GRS Motors Ltd., Jhansi (UP) 284202).

To advise you appropriately full facts of the case are required.
First of all we need to check the Insurance paper of your vehicle and need to check each and every clause of insurance so that you can see upto what amount TATA AIG provide compensation. Second, you need to check whether any commitment was made by TATA Authorised dealer that they will complete the job within a specific period of time (you can also check the receipt provided to you). Even if you did not find any such clause you can approach the consumer forum for a relief.

I would like to advise you that for your first problem if insurance company is not giving you full 50% repairing cost so you can fill a complain before Districtconsumer form for full repairing cost there is very less court fees you may succeed in your complain and get relief. So fir as the 2end relief is concern you will have to fill the suit before the civil court for recovery of loss and will have to prove the loss then only after you can say to court that this is my loss and it should be recovered from the dealer.

You can claim against the dealer company and the insurance company for the losses and the expenses incurred by you
Since you bought it for commercial purpose consumer forum complaint would not entertain it
Civil suit can give you relief as you required it
