Q: How to get stay on transfer order ?

I'm a sub inspector at Sagar ,due to some unknown issue I have got my transfer to another city till next order .I want to put stay on it. how to challenge transfer order ?

Advocate Rohit Jagwani answered
You will have to challenge the transfer order before the Hon'ble High court by filling the writ petition under the provision of article 226 of the Constitution on the basis of trancefer policy of your state other than this no proper remedy is available to you becouse when you will approach to the higher authority then there is very less chances to success in the other hand when you will go before the high court and satisfy the court that the order of trancefer is against the trancefer policy then you will success and get stay order as interim relief and there after court can say you that you go to the higher authority to examine the validity of the trancefer order. I hope this advice Will help you to face the problem and get the relief.

Q: calculate court fees for cheque bounce case in India

How to Calculate Court Fees for Cheque Bounce Case in India?

Advocate Rohit Jagwani answered
The court fees for a cheque bounce case (as per the 2011 rules) are calculated based on the cheque amount involved in the complaint. Here's the breakdown:

  • If the dishonored check amount is up to ₹1 lakh:
    • 5% of the cheque amount, with a minimum of ₹200.
  • If the cheque amount is more than ₹1 lakh and up to ₹5 lakhs:
    • Minimum ₹5,000, plus 4% on the amount exceeding ₹1 lakh.
  • If the cheque amount is more than ₹5 lakhs:
    • Minimum ₹21,000, plus 3% on the amount exceeding ₹5 lakhs, subject to a maximum of ₹150,000.
These court fees for cheque bounce cases help calculate how much you need to pay when filing your complaint under Section 138 of the NI Act.

Q: Procedure to disown son from property

I want to disown my son from my property which is earned by me and also from our ancestral property. Kindly suggest the legal procedure for disowning son. Is it necessary to publish this in newspapers, if yes in how many newspapers.

Advocate Rohit Jagwani answered
As for as I concern you can disown (eject) your son from the property which your own earned property by giving him a legal notice through the lawyer that you don't want to share your own earned property with you that is why you will not be co-owner of my self acquired property, there after your part is over and burder will be shifted upon your son to react upon the legal notice and take legal steps. It is not compulsary that you publish in newspaper about it but you can take this steps for more security. So for as the ancestral property is concern you can not disown (eject) your son from the ancestral property.

Q: I got bad burn on my face after face waxing in a parlour. I don't know what type of products the use

I got bad burn on my face after face waxing in a parlour. I don't know what type of products the used due to which my face is injured. So what can I do for it legally??

Advocate Rohit Jagwani answered
As far as I am concerned it is my best advice to you that you can file a complaint in the consumer commission for compensation. The consumer commission may also stop the selling of bad products. you may also move an application before the police station for lodging FIR against the company who is selling the bad products. i hope this advice will help you to make a decision. if you feel any confusion you may post another enquiry on my profile or you may contact me on my contact number provided on my profile.
