University is wrongly withholding marksheet

I have given my law exams , all fees are cleared for which i have proof, yet the affliated college is not giving my marksheets, to add to it the college abused me and shouted at me when i asked them the same. I had read on the net that i can file a writ in the supreme court under section 32 that its my fundamental right. Kindly suggest as im still a law student.

First of all please make sure that the result has been announced and it is only you or few others who are being deprived of mark sheets. If it is so then first approach the higher authorities like Vice Chancellor, Ministry of HRD and initiate written communications with them. If all these acts remain futile, only in that case approach the concerned High Court by way of a writ petition.

hello, dear its not clear that in which year of the LLB course you are studding or you have completed your LLB final and if you have completed your exam for the final year do you have any communication with the college or university for the same, if all the answers are yes you can file a writ petition in high court for seeking the relief.

Hi, I can understand your obvious concern regarding the withholding of your marksheets. But before I get into the intricacies of your matter. I have a few questions myself. 1) Under what circumstance have they with-held your marksheet? I think all of us on this platform once did go to University , so when a university with holds the marksheet? There's a deeper issue at bay. Were you involved in any disciplinary action instituted by the committee or were indulging in anti-university practices? Once I have a clearer understanding I can provide you with appropriate guidance. 2) Yes, that is correct , at the outset, you can file a Writ Petition at the High Court and institute action. The reasons for with-holding a marksheet have to be under a circumstance or atleast a temporary provisional marksheet ought to be provided to you. There is insufficiency on the part of the university to put you through the present situation. Do let me know if you want to discuss your query further.

As you know colleges cannot withhold the marksheet as this is completely illegal. Even if the colleges has monetary claim, refusal to give the certificates is not the method by which the claim can be enforced. I would not suggest you to directly approach Supreme Court of India. You can file a writ petition in the appropriate High Court under article 226 of Constitution of India to get the relief. If you need any help you can contact my assistant to book a consultation.
