Tenant not giving more money threatening not to vacate house

my aunt has given a 2bhk house for lease for 8 Lakhs from May 1st 2014 the Lease gets over by the end of this month initially the tenants wanted 3 years of extension more later they agreed for 1 year extension & agreed to pay 6 Lakhs more but later backed out now he says that he has already seen another house & paid 1 Lakhs as token advance if we don't pay him by the end of this month he will loose out on the token advance & is threatening us that he will not vacate & will continue for the next 3 years without any extra amount. Initially they had given us 8 Lakhs before the house was built as we were running short of money which he paid every month partially & wanted extra 6 months to vacate now he says that he will not vacate. Please help

What you call as lease is Possession mortgage in legal terminology. Looking at the conduct of your so called tenant, it is better to pay of the amount at the earliest and possession of the house. Otherwise you may have to file suit for recovery of possession at a later date.

You can file a suit for eviction against the tenant and get them evicted through a court order. Contact an advocate for the matter. But you will have to pay a court fee of about rs. 20,000/- which will be decreed against the tenants.

Your tenant can not threaten you - if he does, you should go to the police station and file a complaint on him. As for as the lease is concerned, pay his money back only on the day he vacates - if he doesn't, then you can file a suit and get him vacated

Here as per law..,You should file eviction suit for vacat the house against them including u have a rights to ask them damages..,because they are threatening and giving mentally horrossing you on this basis they should pay you damages also..further details contact us thank you
