REVISION PETITION IN HIGH COURT ALLAHABAD

1-Husband filed divorce in Jaipur in march 2014 u/s 13 HMA .Subjudiced in Jaipur family court. 2-I came to my mothers house with my son in Agra and I filed maintenance in sec125 in agra in july 2015.summon served.Husband did not appear.Exparte order passed in may 2016.I filed for revision in highcourt in july 2016( criminal revision 2162/2016).Summon has been served on husband. Husband has filed 126(2) in agra.I have filed 125(3) in family court agra.Both cases are to put up on 1/11/2016 in family court. My case was listed on 21/10/2016.Nothing happened.Now next date showing on net is in April 2017. Why 6 month date was given by highcourt? In the mean time if my husbands get the order set aside in family court agra than what will happen to my revision petition in Allahabad highcourt?

As per law ,and various rulings of High court and apex court ,cases related to matrimonial disputes are delt with special consideration ,in which both the side are nessary party so even if exparty order are passed it could be revered by the court if found sufficient ground ,you need not to worry about this .For further query contact .

1. आप सबसे पहले तो यह बताऐं कि जब धारा 125 में आपके पक्ष में एक्स पार्टी आर्डर हुआ था, तो आपने किस कारण से मा. उच्च न्यायालय में रिवीजन पिटीशन दायर की...?
2. आप आपके पति के द्वारा दायर तलाक याचिका को मा. सुप्रीम कोर्ट में ट्रांसफर पिटीशन के द्वारा आगरा ट्रांसफर करा सकती हैं ।
3. मा. उच्च न्यायालय में सामान्य तौर पर इसी प्रकार तारीख मिलती है ।
4. धारा 126 (2) के तहत प्रार्थना करना आपके पति का कानूनी अधिकार है , और ससमभ्वः कोर्ट उन पर कुछ कोस्ट ( आर्थिक दण्ड ) लगाकर , अनुमति प्रदान कर देगी ।
5. 1/11/2016 को भी सम्भवतः न्यायालय में दीपावली के त्यौहार के कारण अवकाश रहेगा ।

In this case as the Hon`b High court has opinion and taken a cognisance of the same matter that it be proceed as subjudice before the Family court. Now you has to wait for the judgement till pronounced.

Sorry I didn't get your point why you you filed revision in highcourt against your order although it is in your favour ?you get six month date may be because of so many cases or they want to give you ampule time to let you get your judgement in main case .and if you get the order for set aside your revision automatically fructus
