there are various similar cases in the district and labour courts. the main contention or premise of your defence is the reason you were compelled to quit your job and not serve the notice period. rest depends on the facts and circumstances of the case.

Sir I have perused your query. It must have been mentioned in your employment contract that in case of failure on your part to serve the notice period pursuant to your resignation, legal recourse will be taken by the organisation. This means you have failed to comply with the provisions of contract which have initiated the proceedings against you. The remedy available with you is to settle the matter with the organisation by providing them a valid ground for you non performance of the specified period.

You need to file reply to the suit filed by the company taking all your defenses. Further, you also need to file any counter suit or complaint for any harassment caused to you. The companies normally settle cases with the employees who stand up for their rights and contest the case. Is your case suit no 314/2019?

Query perused. I have few questions. Have you received the summons from the court for appearance? Did you attended any of the hearings? Did they serve any legal notice upon you before filing the law suit? Please share the requisite documents and information. Would represent you and help you in the matter.
