Pecuniary Jurisdiction & Court Fees in Delhi

I need to file a recovery / summary suit in Delhi. The claim amount (principal + interest) is approx 2.5 crores. Can I file it directly in Delhi High court or I need to go to Lower court ? What will be the approx court fees for the same. Can I also claim compensation / damages or I need to file a separate damage suit for the same.

Query perused. In my considered opinion you have to file a suit in the High Court since the value of the suit for recovery is over 2 cr. Court fee payable would be 2, 46, 344. Hi,

The Delhi High Court had amended the rules in 2015, stating that Commercial Matters over Rs.1 Crore , the pecuniary jurisdiction would lie with the Delhi High Court. For any other matter, eg. Sale of Immovable Property not being used for Commercial Purposes, the amount ought to be over Rs. 2 Crores.

In your case, as the amount is in any case over Rs. 2 Crores, you are entitled to file directly at the Delhi High Court. You will have to first inform me whether the nature of recovery is commercial, private, in what capacity in order to determine the Court Fees. You can claim compensation, damages, in the present suit itself and you will have to pay additional court fees for those specific prayers.

for Court fees it will depend upon the actual valuation of the suit but approximately 2% to 4%.

If amount is above 2 crores you can file it before Delhi High Court. The fee is roughly 1% of the claim amount. However, you should not pay court fee on interest i.e. dont include it in the claim amount. Yes you can claim separate compensation and damages as well. Kindly contact for a detailed discussion.

Hi what is the rmattwr and all what does the case say and all what is matter and all about what does the suit say u can file the case directly in Hc first we need to see what is the matter and all about then only I can file it
