My dad's elder brother cheated on partition of ancestral property

We have a ancestral property where it should be equally divided among 3 of them- my dad, elder brother and sister. But elder brother emotionally black mailed and took over the whole property. Now he is torturing... What is the legal procedures we have to take
How the elder one took over the whole property ? The mode of such taking over is important. And you should get hold of copies of the documents and go through them to find out if you have a ground to get it back.
