Legal action against encroachment into private property

We have road backside of our home and after that road we have some land. For now, that is not used by anyone and it if full of bushes and small plants. My neighbour cleaned a part of the road and he leveled some part of our land with road and he is using that space for keeping his cattles. He is planning to occupy that road including our land. We have asked already asked him to take out his cattles from there. But he replied roughly as 'Im not going to do that, do as your wish'. What should we do now?

Yes, sure you can go to court asking for demolishing the building etc.,. Now you have to explain to Court what was the reason you did not do anything to prevent him from starting the building in question

Dear Sir, madam

In my opinion I don't know that construction is on going or starting also it's your share of property. You may file injunction suit against him according the law of cpc code order 39 rule​1. You may get relief.

If you have ownership documents as evidence, first you have to lodge a complaint with the police for criminal trespassing and threatening. You can also give your complaint to your District Collector, Revenue Divisonal Officer, Tahsildar for necessary action for illegal encroachment by your neighbour
