How to sale plot after false FIR is registered against owners.

My dad has a plot in my native town. A factory stands upon the plot which has been shut down since four years due to dispute between the partners( my father and uncles). Now, that we want to sell the plot we had given legal notice to the partners to vacate the plot within 60 days. After 60 days, when we went to vacate the land, a fake FIR has been filed against my father stating that the everyone has the right upon the land and that my father has hidden away the documents and is harassing my grand father whenever he asks for the documents. The title deed is in my dad's name and we also have a loan sanctioned against the plot. Since, we are unable to bear the interest burden we want to sell it to a developer. What should be our approach to get it vacated and get away from this FIR?

File eviction suit in civil Court against your partners.U can also file counter FIR or take steps in proper court for quashing FIR if it is registered.Consult your local experienced advocate who can advise after hearing your complete case

Fir is a separate and vital thing ...It's a criminal procedure it's never restrained your father to alienate the property which is owned by himself by his own money Rather than his ancestral but if he was in contract with your uncle for business or anything else regarding this property so you can go for a civil suit for taking this ...

Filing a false fir the police will enquire the matter and will register a criminal case. Though your disputes is regarding land it's a purely civil dispute. The land stands recorded in the name of your father. Firstly you have to see Whether your father during initiations of business have entered into an agreement with Ur uncles. If not you can file a suit for eviction before the civil court.
