Prove the defamatory matter as a true fact against the complainant. This is what you can do in a defamatory suit. Provide evidence to facilitate those facts. Regards Ruchit Dugar Advocate Delhi high court

If, a false criminal case has been filed against you, you may approach High Court under Sec. 482 CrPC and seek quashing of the proceedings. Simultaneously, you may file a case for malicious prosecution with Metropoliton Magistrate. Your second query is not clear. If someone files a criminal case against you, it will be mandated for that person to first present the evidence. Only after that you will be asked to present your case/evidence.

Attend the case hearing and file your written statement (reply). State complete true facts and incident to safe guard yourself. File your written statement through a lawyer who may put the onus from you to the opposite party. And proceed according to situation and stages of your case.
