Didn't pay the full amount for sale agreement now claiming after 22yrs

11-Nov-2023 (In Civil Law)
Went into Sale Agreement in 1991 and paid partial amount. In 2013 claiming the said property on basis of Sale Agreement with partial payment. Is it valid document after 22 years of agreement and without paying the full amount in a said 3 months of time?

Agreement is not enforceable as the prospective purchaser failed to perform his part of contract in paying balance sale consideration ant to get the sale deed registered within stipulated period and the advance consideration is forfeited.

the sale agreement executed in 1991 with parital amount paid is barred by limitation and it is not valid any more to claim the property with partial payment. Hence the sale agreement does not have any legal sanctitiy

Hi The sale agreement will now considered be nullity. Any agreement of sale has to be acted upon with in 3 years from the date of agreement or the tenure specified in the agreement of sale. The party who made the partial payment in 1991 cannot claim relief under specific relief act as law of limitation will prohibit the person from making a claim after 22 years. So no worries.
