Daughter claiming right in compensation given for father's accident

05-Dec-2023 (In Civil Law)
My Father died in an accident intestate. My elder sister is married and our old house was demolished by Railway with a nominal compensation and the higher amount compensation is ready to be disbursed. Is there a way that the complete compensation goes to my mother's bank account and we don't want to give anything to our sister.

No One can claim from the death claim, given to the wife of deceased,

You mother have absolute right icclaimentire claim.
If only your mother have file the claim petition then no one else will get anything from the death claim.

All the children got equal share in case of death of father intestate. The only way to get the compensation amount in your mother account is that all the children surrender their share in favour of mother by way of affidavit and indemnity bond. regards, Adv malhotra

Firstly you should provide complete information as the date and year of the death of your father and thereafter list of the legal heirs such as how many brother and sisters you have? after that only i will be able to guide you regarding the same
