Can son be appointed compensatory if father has died

My father was a police sub inspector in up police. He died while performing his duties on 4 jan 2006. After that we applied for compensatory appointment for my elder brother. It has been a long time but they have not given us the job. And now they have said that your brother is unfit for job. Now what can we do in that matter ?

Yes you have right for compensatory appointments if your brother is unfit for the job he may get other type of job in same department or if you want to do this and you are fit for this so you may apply for the same .inspite of all option if you didn't get job than you may suit them

In your question you don't say what are saying to police authoritie when you apply compensatory appointment "unfit" which area you don't disclose and in these matter if applicant is unfit to police job then authority give him any suitable job where he fit so nothing is worry meet personally any advocate and give all details he do what is correct for you .Ok

Dear Sir,
I am sure you are aware that there is a time limitation for getting compensatory appointments (Five years). Since that has already passed you will face a difficulty in establishing your case. Assuming you have been in touch (written) with the department, you may try filing a Writ in High Court, however I doubt if it will help. The only way how High Court can help you is that if you can prove that there was long delay from department and not from your side. When did you get the information that your brother is unfit- based upon this you may try and circumnavigate the limitation aspect.

You have an option that you file a writ petition before high Court. You must have filed it earlier though it's late but challenge that order which says you are unfit by showing that you are fit for the job

Every department has its own rules as per which they do appointment as per dying in harness ground .Yes under Uttar Pradesh police rules there is such provision .Just want to get through the details of your case then only I can advise you in details.contact me ,I am practicing advocate of Allahabad high court !
