Boy claiming to have given money to me but he has not done so

06-Dec-2023 (In Civil Law)
Respected Sir I am in great stress and suffering from a kind of Mental negativity from the last 16 months.A boy has been harashing me by sending summons, which affected a lot to me in my family as i belong from from a small village of Golaghat district and getting such notices is a great deal.On last August 2016 he send me a notice charging under section 417 by the Titabar subdivision Court and after a long process of visit to the court, his charges were found to be wrong and i was free from the charges on July 2017. Now again he is sending me the legal notice stating to compensate an amount of Rs.200500 mentioning that he and his family took care of my studies, which is all wrong. The all fact was that we were good friend by the begining of 2014 and thereafter knew each other but after knowing all his bad habits such as drinking alchohols, using abusive words, etc. I rejected his proposal to get marry for which he took those steps.

You straight away reject his charge of having spent money on your requirements. Money can not be claimed like this . If the boy spent money on you keeping in mind his future marriage with you that is legally not tenable.

Please send me copy of those notices. Without going through your documents it would be very difficult to advice you. Also send me details of the earlier case before the Titabar court which you mentioned in your query.

There are three major law points by which you can come out of false case in shortest possible time.

i) If the complaint/case itself do not constitute any offence under law.
ii) If the case does not have reasonable evidence against you.
iii) If you can give any proof in Court, which clearly shows that without any reasonable doubt – you have committed no offence.
Kindly contact a lawyer from your area to give you proper guidance regarding the procedure.
