How to gain child's custody

my husband has kept my son forcibly.my son is five n half years.what is the actual age for which mother can get custody.
The father can not claim custody of a minor child minimum till 5 years of age.
But mother also have a right of custody of the minor child after 5 years.

From various judicial pronouncements the child below the age of 8-9 years and in the car of females even older has been fixed that the custody shall be granted to the mother and in some circumstances the same can go to the father. You should challenge the custody of father and seek custody of our children from the family courts.
