Custodian Rights of a mother over grand parents

Hi, I m widow, my son is 8 n half yrs old.His grandparents wants to meet him but i don't want that b'coz i m afraid of them.So i started living with my parents.They(in-laws) filled a petition in high court lucknow that my father captive me n my child.So pls let me know what r my rights to take child custody from my in-laws. THNX

A mother's custody rights nearly always take precedence over those of a grandparent. The only exception is if the mother is deemed unfit or unable to serve as the primary caretaker of a child. In that situation, a grandparent is in a position to seek custody of the child.

absolutely they have rights but u can after consulting with a lawyer can defend that easily here u didnt mentioned much information... and the case for custody and guardianship comes under section 25 of guardianship and wards act.

Hello madam, u r a real mother of ur child. Tell the court that ur eligible in pay school fees and every thing which are compulsary for child's bright future. U have a good atmosphere and u r a better care taker for ur child not ur in-laws.
