Child visit during ongoing case of restitution of conjugal rights

I have filed a Restitution of conjugal right against my wife as she is not coming back from her home after a small issue and is staying there for almost 2.5 years now. We have a daughter and she is 2 years old and I am not able to see her as whenever I go to her home, they are creating new issues and telling they might come back after one year and all. So the RCR has been filed almost 3-4 months back and they are not appearing before the court. Now the court asked us to appear on last Friday and they again get it postponed to October. May I know who is in charge of deciding the dates ? Also as I am not able to see the kid, is it possible to file any other petition to see the kid while this process is going on ? We are Christian (Catholic) and married on 2015 January.

Hi,..in court judge is the final authority to decide with the cases.if they are not appearing before the court you can request the court for their presence and in the mean time you can file ia for visitation rights.
