Can a mother use child's FD money and invest it somewhere else.

As a divorce settlement, father wants to set aside money for his daughter in the form of F.D, while mother has the custody of the child. But, the mother fears that FD rates may come down in future and if she wants to liquidate FD in future and invest that money somewhere else where returns are high, can she use the child's money?

I think I have a favourable view for you and it is that Guardian of a child can take the decision in his or her fever but there is a condition and condition is that search decision should be bonafide and as in your case your husband I want to liquidate FD which is in your child's favour so here my opinion is that your husband is not acting under bonafide so he cannot liquidate FD and for that purpose if you have an apprehension you can file an injunction suit against your ex husband

in above circumstances you are only guardian of the child till she major till then you can't use money without permission of the court.

It needs to be cleared that if there is any clause that the concerned money in the form of FD cannot be used till the child attains maturity, then you as a mother cannot use the amount but if there is no clause then you can use the said money for the welfare of the child.
