What to do if the college gave me a cheque and that dishonored

01-Jun-2023 (In Cheque Bounce Law)
I was on the faculty of a college and they paid me by a cheque which was not honoured by the bank for lack of funds. The same was duly informed to the paying authorities and was promised a new cheque/ money transfer to my account. It's been over Four Years and I have yet not received the payment despite reminders.

Validity of Cheque is only 3 months, Now you can not file a case in NI-138. But you can file a case for recovery after a Legal notice....

As you did not send a legal notice within 30 days of the bouncing off the cheque, you are barred by limitation to file a case under section 138 i.e. complaint against bouncing off cheque. However you can still file a civil suit for recovery of money.

You should take the legal remedy under sec 138 N.I.Act for receiving your money from your friend and also under CPC for recovery of your money if the limitation period for filing under 138 N.I.Act will lapsed.
