What precaution should i take before giving surety for bail
25-Jun-2023 (In Cheque Bounce Law)
Hi, my close relative is asking for surety for bail. Asking for salary certificate related to my Job. what are the precautions I should take and what is the impact if he is proven guilty or not appeared to court ?
Hi...first you have to know under which section your relative asking you to give bail. If after furnishing surety if your relative is not attending the court then your surety will be forfeited by the court.
Thank you
Thank you
It's better not to give surity if u are not confident abt the person who is a accused . In case he abscond then you will be liable for it and they can recover the amount from you in it's a cheque bounce case .
Being surety is always risky before court and its an liability for which court asks you to be held responsible if the party escapes from his liability for example if is there any due which has to be be paid by the party for which he escapes or absconds then court will shift the burden on your shoulder to comply the same for which the main party was responsible. So be cautious and know about the party's repaying capacity or complying his wrong before the court and then only you have to proceed. Its purely depends on your understanding and faith with the wrong doer and it doesn't need or have any preparations or precautions under law.
