What is the procedure to file a cheque bounce case.

I want suite case on friend cheque bonce case but I don't have his cheque to bonce but I have only proof is I have transfer amount through neft / rtgs

If you don't have cheque you cannot file cheque bounce case

If neft and RTGS proof receipt is their on transfer of money to your friend account you can file suit for recovery of money on payment of stamp duty, and you can recover interest also.

Cheque bounce case is a criminal proceedings for offence under section 138 of Negotiable Instrument Act for bounce of cheque issued by debtor without maintaining sufficient funds in his account.

You may only file a civil case for recovery of money. Unless you have cheque issued by the Accused, it bounces on depositing it into your bank account, you cannot file a cheque bounce case. Ask your friend to return your money or give a cheque towards repayment of your money.

Dear Sir,
If u don't have cheque of Ur friend u can't dishonored and also cont file case against him dishonored of cheque but based on Ur bank statement u can file case for recovery before civil court but before filing case it is good sent legal notice.
