What is minimum time for disposal of cheque bounce case

Cheque bounce case - Judgement Disposal time in general? what would be the punishment? If cheque issued person not traceable what is the way out? Thanks in advance

Dear client,
It is a case under summary procedure, that mean the case under cheque bounce should be completed within 6 months. Due to pendancy of cases and defense of the accused, it takes nearly two to three years. As per law accused should be punishable for 2 years rigorous imprisonment and complaint will be granted double the cheaque amount and a fine will be imposed on accused. In default of paying compensation of double the cheque amount and fine, the accused will be further sentenced to further imprisonment of six months or so. If cheque issued person not traceable courts will keep the case for some more days after issuance of Non bailable warrant and turn the same as long pending case and if the accused has properties those properties will be sold and recovered the cheque amount like revenue recovery of the state.

There is no min or max time which cannot be informed at this stage. it depends on various other factors like service of summons, judges and appearance of the other party etc.

First court issues summons if the summons are served, court can issue aand yet he is not appearing then a non bailable warrant is issued and after that a proclamation and an order for attachment for the property may be issued by the court.

There is no particular time frame for disposal of cheque bounce cases. The process of cheque bounce cases depends on many factors which cannot be forecasted beforehand.The punishment for cheque bounce cases is 2 years of imprisonment or payment of double of the cheque amount. If cheque issued person is not traceable, the court will issue NBW for the police to trace the accused and execute the same against him.
