We were asked to put date on the cheque,cheque bounced when deposited

Sir, We have sold some material to our party in Greater Noida ( Uttar Pradesh ) in the year, Oct. 2011, they have paid some amount of bill in cash and the balance amount Rs. 119000/- issue the cheque without date and told us that we have inform you on phone whenever fund will available in there account, than you put the date on cheque and submit in your Bank, finally we have put the date on cheque 06.11.2015, and now the cheque is bounced due to insufficient fund they are not picking our phone, please suggest us batter legal option.

You have to legal notice through advocate to them .if still ur not paid money then a case under 138 NI act is to be filed . remind you that this case time bound for example notice should be served with in 30 days of dishonour . u may call me in case of need.

Greetings Sir. Sir as per your query, if i may say that you are well within time. As per the Negotiable Instruments Act, you have period of 30 days since the date of bouncing of the cheque, to issue a legal notice (preferably to be sent by a lawyer), to the opposite party, demanding in that said notice that the pending amount be paid to you within 15 days of the receipt of notice etc. etc. If, however, he does not pay within such 15 days then you may file a case under section 138 of the NI Act and the opposite party is liable to be proceeded against.
