Yes, if there is a deficiency in service, then a person can sue another for compensation etc.. we will have to see if there was any deficiency or if there was an inadvertent error on your behalf. Consult a lawyer, if you are sued.

Q: Both agree for mutual divorce but family is not agreeing what to do?

Both parties agree upon mutual settlement of divorce within 20 days. Of marraige. But now girl side people are deferring the matter since 2 years. What is the remedy available legally for boy ??

Advocate Mudita Sharda answered
Dear sirIf both parties agree then thats the end of the matter legally. You may file for a mutual divorce which can be decided within 6 months. However, if this doesnt pan out then you may file for a contested divorce petition which will be contested by your wife and her family and that may lead to a prolonged litigation spread over years. Seek a lawyers advice personally

Q: What is the procedure for mutual divorce?

I have been married for 3 and a half years now. Me and my husband are wiling to file for mutual divorce. What is the procedure for divorce?

Advocate Mudita Sharda answered
HiThe procedure is simple. Both parties come together and file a divorce petition with a mutual consent between them. This is a 2-stage/motion procedure. You will file the first motion petition along with an MOU today and the second motion after 6 months of first motion. In 6 months all tour rights and liabilities will be finalised. In case you stretch the matter for whatever reasons, you my do it upto 18 months. Divorce decree os granted after recording your statement in 2nd motion proceedings.

Q: Bank forcing to pay money for Credit card which was stolen

i was robbed on gunpoint and all my cards were stolen. they even forcefully took the pin and from which they withdrew 1,10,000 from my credit card i even filed a complaint next day to the bank and online FIR was lodged. after all this the bank sends notice that the customer is liable to pay the for the money. please suggest me?

Advocate Mudita Sharda answered
Dear queristGood that you filed a complaintbin this regard. Now what i suggest is that suitably reply to the said notice and attach a copy of the complaint with the letter. You may also hire a lawyer to draft the same. Incase, the bank is not satisfied with your answer, they will file a recovery case against you. In that event, you will definitely need a lawyer. As of now, send them a reply to their notice ASAP

Q: Husband threatens me to divorce and doesn't let son visit my home

Its been 13 years of marriage. My husband threatens me of divorce. He doesn't like me visiting the my parents home and doesn't let my son who is 12 years old go along with me. What are my rights? What action can i take against him?

Advocate Mudita Sharda answered
Hello madamI am unable to conclude as to how does the husband threaten you? Is it only verbally or physically or both? And do you simply not go to your parents' house because he threatens you? He must do something else that makes you stop? Your query is not clear.Having said that, you always have the option of filing a complaint against your husband for domestic violence. Make sure that your complaint is detailed and detail it in a manner which can be later proved by you. For starters, you may file a complaint.
