12-Jul-2023 (In Cheque Bounce Law)
Son issues a cheque of amount X and got bounced and filed a 138 NI act case, again Father issued another cheque of amount Rs X+(loss). 1. Is two separate cheque bounce against son and father is maintainable ? or just one then which one ? Father is in Govt. Job so would like to maintain that. 2. Also Case u/s 420/406 IPC is maintainable against fraud done and both cheque been part of conspiracy ? 3. Can police/court quash Case u/s 420 or Can court quash any of the cheque bounce case or can both be clubbed as one ?

Cheque bounce case is only maintainable between two parties, i.e signatory/ issuing party and the party who receives the same. If two different cheques issued by two different persons and has been bounced then two separate cases are maintainable. However both can be clubbed depending upon the nature of the facts. For any further legal please feel free to contact

Thanks

Hi sir

first of all, civil and criminal procedure are seperate, you can initiate 138 for the dishonour and along side file a complaint under 420 for cheating. will need more details to advice you further.
