Time limit for notice and case filing

In case person has given cheque against friendly loan of Rs. Ten Lacs. And cheques got bounced. In this case time limit for sending notice through adv and filing case in court. And what is time limit in case of non acceptance of notice.

time limit can be increased by way of a fresh cause of action. thereafter, you can expeditiously conduct tye matter and get your money back. a lapse of too much time will only weaken your case and you'll end up not getting your money back.

if the notice is not accepted and received by the sender with a postal remarks. the said notice is deemed to be delivered to counterpart of the sender. In such an event the holder of the cheque may file a complaint u/s 138 within 15 days of knowledge of postal remarks. if that time limit has surpassed then one may always file civil suit for recovery of money.

Time limit for sending notice through an advocate in case of cheque bounce is 30 days from the cheque bounce date but this also depends on the date on the actual cheque and within what time has it been presented to the bank. Even if notice is not accepted, the time period is the same. This depends on the facts of the case. For information in detail, the cheque which has been bounced and the bank statement regarding the same is necessary which has to be looked into by the lawyer.
