you may send a legal notice within 30 days , and you can wait till 15 for reply or payment. if u do not receive the same u may file a case within 30 days total maximum time is 75 days if its get delay than u have to give sufficient cause of delay. but its allow or not will depend upon the court only

Hello Once you the cheque is dishonoured and you receive a memo of dishonour from bank then from the said date you have 30 days to send legal notice under section 138 of NI act thereafter once the notice is sent you have to wait for 15 days as it is their response period and once the said 15 days gets over you can file complaint under the provision of NI Act but the same has to be filed within 30 days
