Q: Can a daughter evict her father?

My parents have been married for 20 years and my father has always been abusive. We are Hindus and I\'m an only child. He does not contribute in the household expenses. My mother filed for a divorce in 2017 but took it back after my father beat her up.The house we live in belongs solely to me and my mother.I have told him to leave multiple times but he doesn\'t.Even my mother wants him out.I\'ll be 18 in November 2023.Please tell me how should I evict him?

Advocate Siddharth Tatiya answered
I'm sorry to hear about your situation. We'll need to gather sufficient proof/ evidence to support our allegations on abuse (mental/ physical) and other applicable crimes. You can file cases accordingly after you turn 18.

Q: Someone forcefully take the possession of house

I have file an fir, and its registered under 457 and arrested the person bhut police don\'t evict them from property and police saying they have no right to evict the trespassers from property. Is it true that police has no right to evict trespassers from the victim property. And what can else I do in that condition

Advocate Siddharth Tatiya answered
If there's any oral or written agreement with the trespassers, then the police would generally avoid eviction because then the process stipulated under the Rent Control Act needs to be followed. You may however try concluding the trial expeditiously.
