TGS properties cheque bounce

Dear Sir/Madam, I had received 2 cheques from TGS properties which was bounced on 23rd Aug 2016 due to insufficient funds. When I contacted them, they told they will issue a DD next month on 28th Sept 2016. My question is, what is the stipulated duration to file a complaint after the cheque is bounced. Thanks

You have not mentioned the date of these cheques. A cheque is valid for a period of three months from the date mentioned on it. You may present the cheque to bank for encashment any number of times before its validity period. After receiving the cheque return memo from the bank you need to issue a legal notice to the drawer within one month from the date of intimation from bank. You can issue notice only once. Here, in your case cheque has bounced on 23.08.2016. You need to issue legal notice on or before 23.09.2016 failing which you will not be able to file cheque bounce case. TGS properties seems to be very clever and cunning. Be careful.

you need first issue a legal notice within 30 days from the date of Bank Memo communicating you about the bounced Cheque, which is as per Negotiable Instrument Act. So i suggest you to first issue a legal notice. If you wait till 28th of Sept, 2016 then you cannot take any action under Negotiable Instrument Act.

Dear Querist,
After u recieve Bankers Memo you have to issue Statutory Legal notice within 30 days giving the Developer/ Bldr 15 days time to repay your amount, if the Developer/Bldr fails to pay u r cheque amount within 15 days you have to file a Criminal compliant before the jurisdictional magistrate court within 30 days.

A cheque may be presented to the Bank any No. of times during its validity even after the same is bounced. But once one decide to take legal recourse, a legal notice is to be issued within a month of its dishonour giving the drawee clear 15 days time to make the payment. If the drawee of the chque fails to make the payment within 15 days from the date of receipt of the same, a private complaint has to be filed before the jurisdictional Magistrate within one month after expiry of the 15 days time
