Steps to be taken if cheque gets bounced and unable to repay money

I have two check bounces unfortunately I couldn't pay that money they're are saying that they will put case on me and it will be criminal offense please let me know what should I do and what will happen

Within 30days from the date of dishnour of cheque issue notice through counsel to the drawer informing the dishonour of cheque and demand to pay the cheque amount within fifteen days. If he fails to repay file complaint under Section 138 of NI Act before the Magistrate Court having jurisdiction where the payer bank located.

Sir/madam, Cheque dishonour is filed if the cheque signed by the issuer in discharge of the legally enforceable debt only and not otherwise.If the case is true and you are legally obliged to pay, unless it is barred by limitation. If not , you can contest the case and you can seek bail and you can prove your innocence. If its proved the impriosonment shall be upto 2 yrs or fine twice of the cheque amount or both.

Try to pursue the matter with the lender and pay the amount in installments if they consider accepting the same and compromise the matter out of court. However, if they are hell bent on filing the case, let them file the case and when you receive summons from the court for your appearance, engage a cheque bounce case lawyer and appear in the court and seek time from court to pay the money.

First of all try to talk to them and resolve the matter arranging a meeting and take time to arrange for the amount. If they do not give time and send you a legal notice then you need to reply to the notice. Cheque bounce is a criminal offence u/s. 138. You have to arrange the amount or else go for a trial in the court of law.
