The threat of prosecution usually results in prompt settlement (if the drawer is an individual, the proceedings would happen under Section 138 of the NI Act. In case of a company, its managing director can be personally prosecuted under Section 141). The demand notice from a lawyer must be sent within 30 days from the date you found out that the cheque issued to you bounced. Its purpose is to demand payment and inform the issuer that he or she will be prosecuted if payment is not made within 15 days.

Dear Client,

You would be required to sent them a legal notice and thereafter a case under section 138 NI Act would be filed.
Hon'ble Court has ample power to exercise it's jurisdiction for summoning the accused.

I have seen your query. Agar cheque bounce ke case main accused tarikh per nahi aata hai tou court uske khilaf pehle tou bailable warrant uske baad non bailable warrant issue karti hai lekin usse Pehle case dalne ke liye cheque bounce hone ke baad 15 Dino ka notice dena jaroori hota hai uske baad hi case dal sakte hain warrant per bhi muljim nahi court main appear hota hai tou court kurki ka notice dekar kurki karwa sakti hai. if you want any further information or any other advice then contact me without any hesitation through administrator of this website
