Opportunity of Accused to cross examination complainant is closed
09-May-2025 (In Cheque Bounce Law)
I am a complainant in cheque bounce case and it's start since 2017. After all stage accused advocate cross examined me on nov 2024 for four hour and due to court no time left passed to next date. But from Nov 2024 accused taking adjournment from last 6 months beside last opportunity and fine. Now magistrate on may 2025 close accused opportunity to cross further complainant. Will this order be easily set a side if accused file application.
in the case of cheque bounce under NI act complainant or agreived person take money to the other party by the order of magistrate within 6 month form the filing of complaint
many judgement on the same issue passed by the honble supreme court and High court
but many cases magistrate court not trial the case speedy
on the above mentioned query please note down that if court orders cost on either party for non appearance or any other cause, the party can't take legal action against such order without paying the cost in limitation of maximum 30 days or on the next hearing. in this matter the accused can't afford opportunity because he could not deposit the cost in the court
